Jaguar Land Rover wins ruling against Evoque copy


Jaguar Land Rover has won a landmark case against Jiangling Motor Corporation for producing a copy of the Range Rover Evoque in the Landwind X7, which has been deemed to have ‘led to widespread consumer confusion’ due to the similarity between the two vehicles.

The Beijing Chaoyang District Court decreed that the Evoque has five unique features that were copied directly in the Landwind X7, and has determined that all sales, manufacturing and marketing of the Landwind X7 must stop immediately, and that Jaguar Land Rover be paid compensation.

The Chinese copy of the Evoque had already courted complaints as far back as 2015 from the British group of brands, and formally sued the company a year after that.

“We welcome this decision of the Beijing Court, which further strengthens our confidence in investing in China and in the fairness of intellectual property adjudication in the Chinese courts. This ruling is a clear sign of the law being implemented appropriately to protect consumers and uphold their rights so that they are not confused or misled, whilst protecting business investment in design and innovation,” said Jaguar Land Rover head of legal, Keith Benjamin.

The current, second-generation Range Rover Evoque was launched last November, succeeding the first-generation model which made its debut in 2011. The latest iteration will make its China debut at the Shanghai Motor Show this April.
