The Supreme Court of India has clarified that the law does not permit any type of modification to cars or bikes that alter the specifications of the manufacturer. Modifications made outside of the purview of what is mentioned on the vehicle’s registration certificate will be deemed illegal.
Without going into specifics, the court said that an alteration or modification is a change in the structure of a vehicle. The court has also clarified that modified exhausts, change in exterior paint, tyre size and even parts like spoilers and body panels can be considered outside the purview of the law.
The apex court upheld the provisions under the amended Motor Vehicle Act, which specify that vehicles cannot be altered in order to ensure their road worthiness.
Earlier, a division bench of the Kerala High Court had passed a judgement saying that structural alteration was permissible as per the provisions of the Kerala Motor Vehicle Rules, 1989.
